Mobile App Terms of Service

Welcome to Every Wag. These Terms of Service (“Terms”) govern your access to and use of the Every Wag mobile application (the “App”), owned and operated by Oh Rover, LLC d/b/a Every Wag, a Florida limited liability company (“Oh Rover,” “Every Wag,” “we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not download or use the App.
These Terms apply to the Every Wag mobile application only. Use of the Every Wag website is governed by our Website Terms of Use. Use of the Care Connect clinic platform is governed by the Every Wag Clinic Terms of Service. All documents are available at everywag.com/legal.
1. Overview of the App
Every Wag is a digital pet care application designed to help pet owners manage their animals’ daily and long-term health and wellness. The App offers features including:
- Routine scheduling, reminders, and care tracking
- Health and behavior logging
- Personalized pet profiles supporting multiple species
- Record uploads and document storage
- Data insights and species-specific care suggestions
- The ability to share pet care access with co-owners or caretakers
- Connection to participating veterinary clinics through the Care Connect feature
- Care guide delivery and progress tracking when linked to a clinic
All content provided through the App is for informational purposes only and is not a substitute for professional veterinary advice, diagnosis, or treatment. Every Wag is not a licensed veterinary provider and does not diagnose, treat, or prescribe for animals.
2. Eligibility
You must be at least 13 years old to use the App. If you are between the ages of 13 and 17, you must have the permission and supervision of your parent or legal guardian. By using the App, you represent that you meet these eligibility requirements. If we learn that a user does not meet these requirements, we may terminate their account.
The App is intended for use by residents of the United States. We make no representation that the App is appropriate or available for use in other locations.
3. User Accounts and Responsibilities
You must provide accurate and complete information when registering an account and agree to keep that information current. You are responsible for safeguarding your account credentials and agree not to share them with others. You are responsible for all activity that occurs under your account, whether or not you authorized it.
You agree not to:
- Upload false, misleading, or harmful content
- Attempt to gain unauthorized access to our systems or interfere with the App’s operation
- Use the App in any way that violates applicable federal, state, or local law
- Reverse-engineer, decompile, or attempt to extract the source code of the App
- Use the App to transmit spam, malware, or other harmful content
- Use automated tools, bots, or scripts to access or interact with the App
- Use the App for any commercial purpose other than managing your own pets’ care
You are solely responsible for the content and data you upload to the App. If you choose to share pet profiles with co-owners or caretakers, you control and authorize their access. If you choose to link your account to a veterinary clinic through the Care Connect feature, that connection is governed by Section 8 of these Terms.
4. Subscription and Payments
Every Wag offers a freemium model. Basic features are available at no cost. You may upgrade to a Premium subscription, billed monthly or annually, after a free trial period. Subscription fees are charged through the Apple App Store, Google Play Store, or through payment processors we partner with, depending on how you access the App.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Cancellations must be made through the platform you used to subscribe (App Store, Google Play, or our website). Refunds are subject to the policies of the applicable app store or payment processor.
Every Wag reserves the right to change subscription pricing at any time. We will provide at least thirty (30) days’ notice of material pricing changes through the App or by email before the change takes effect. Your continued use of the App after a pricing change takes effect constitutes your acceptance of the new pricing.
5. Data Collection and Privacy
By using the App, you agree to our collection and use of certain information as described in our Privacy Policy, available at everywag.com/privacy-policy. This includes your name, email address, pet information, and, with your permission, your location. We use third-party analytics tools, including Mixpanel, to help us understand how the App is used and improve its performance. You can opt out of analytics tracking at any time in the App Settings.
If you choose to link your Every Wag account to a veterinary clinic, certain information will be shared with that clinic as described in Section 8 and in our Privacy Policy. By linking to a clinic, you consent to that data sharing.
6. Content and Advice Disclaimer
The content provided in the App — including health tracking tools, calorie recommendations, body condition scoring, care suggestions, and any care guides delivered through the Care Connect feature — is general in nature and not a substitute for professional veterinary care.
Every Wag is not a licensed veterinary provider and does not diagnose, treat, or prescribe for animals. You should always consult a licensed veterinarian before making changes to your pet’s diet, medications, health routine, or care plan.
Care guides assigned by a clinic through the Care Connect feature are created and owned by that clinic. Every Wag delivers and tracks these guides but does not review, validate, or endorse their content. Any questions or concerns about a care guide should be directed to your veterinary clinic.
You acknowledge and agree that any reliance on content provided through the App, including care guides, is at your own risk. Every Wag shall not be liable for any health outcomes for your pets resulting from your use of or reliance on App content.
7. User-Generated Content
You retain ownership of content you create and upload to the App, including notes, photos, health logs, and documents (“User Content”). By uploading User Content, you grant Every Wag a limited, non-exclusive, royalty-free license to store, display, process, and transmit that content for the purpose of providing the App’s features to you and, in aggregated or de-identified form, for the purpose of improving, developing, and operating the App and its features.
You represent and warrant that you have the right to upload any content you submit and that your User Content does not infringe or violate the rights of any third party, including intellectual property rights, privacy rights, or publicity rights. Every Wag does not review User Content and is not responsible for its accuracy or appropriateness.
If you choose to share files with a linked clinic through the Care Connect feature, that sharing is an opt-in action you must expressly enable on a per-file basis. Shared files may be retained by the clinic for veterinary record-keeping purposes as described in Section 8 and in our Privacy Policy.
8. Care Connect — Clinic Linking
8.1 What Care Connect Is
Care Connect is a feature within the Every Wag App that allows you to voluntarily connect your account to a participating veterinary clinic. For purposes of this Section 8, “clinic” refers to any veterinary clinic, hospital, animal care practice, or veterinary professional registered on the Care Connect platform. Once linked, the clinic can view certain information about you and your pets through the Care Connect web platform and can assign care guides to you through the App.
8.2 Linking Is Voluntary
Linking your account to a clinic is always your choice. Under the Every Wag Clinic Terms of Service, clinics are prohibited from requiring account linking as a condition of receiving veterinary care. Your decision not to link does not affect the care your pet receives.
8.3 Information Shared When Linked
When you link to a clinic, the following information becomes visible to that clinic:
- Your name and email address
- Pet name, species, breed, neutered/spayed status, and microchip number for pets assigned to that clinic
- Data entries and their notes for health charts of linked pets.
- Care plan progress, including completion status of care guides the clinic assigns to you
Your personal notes in the App are never visible to a clinic. Files are only shared if you explicitly enable sharing on a per-file basis.
8.4 Clinic Communications
Once linked, a clinic may send you care-related communications through the App, including care guide reminders, appointment information, discharge follow-up messages, practice announcements, and two-way messages related to your pet’s care.
8.5 Unlinking
You may unlink from a clinic’s Care Connect account at any time through the App. Upon unlinking, the clinic will no longer receive updated information from your account. However, records and files shared while your accounts were linked may be retained by the clinic for veterinary record-keeping purposes. For more information, see our Privacy Policy.
8.6 Clinic Terms Govern the Clinic’s Obligations
The clinic’s access to and use of your data through Care Connect is governed by the Every Wag Clinic Terms of Service and Data Processing Addendum, which the clinic agrees to when subscribing to the Care Connect platform. Under those agreements, clinics are required to use your data only for veterinary care purposes and may not sell or share it with third parties.
9. Intellectual Property
All materials in the App — including text, graphics, logos, icons, software, and care guide templates — are owned by Every Wag or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not use, reproduce, or distribute any content from the App without our prior written consent, except for your own personal, non-commercial use. Nothing in these Terms grants you any rights in Every Wag’s trademarks, logos, or brand elements.
10. Third-Party Services and Links
The App may integrate with or link to third-party services, including app stores, payment processors, analytics providers, and veterinary clinic platforms. These third-party services are governed by their own terms and privacy policies. Every Wag is not responsible for the practices, content, or availability of any third-party service.
Your use of third-party services accessed through the App, including the Apple App Store and Google Play Store, is subject to those platforms’ terms and conditions.
11. Termination and Suspension
You may delete your account at any time through the App or by contacting us at info@everywag.com. Upon account deletion, your data will be handled in accordance with our Privacy Policy.
Every Wag may suspend or terminate your access to the App, with or without prior notice, for conduct that violates these Terms, is harmful to other users or third parties, or that we determine in our reasonable discretion requires immediate action to protect the App or its users.
Upon termination, your right to use the App ends immediately. Sections of these Terms that by their nature should survive termination — including Sections 6, 7, 8, 9, 12, 13, and 14 — will continue to apply.
12. Disclaimers and Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERYWAG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYWAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING ANY HEALTH OUTCOMES FOR YOUR PETS BASED ON APP CONTENT OR CARE GUIDE RECOMMENDATIONS.
Every Wag’s total liability to you for any claim arising from your use of the App shall not exceed the total subscription fees you paid to Every Wag in the three (3) months preceding the event giving rise to the claim, or ten dollars ($10.00), whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Oh Rover, LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the App in violation of these Terms; (b) your User Content; (c) your violation of any applicable law or regulation; or (d) your violation of any third party’s rights.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from these Terms that cannot be resolved informally shall first be subject to a thirty (30)-day informal resolution period, which begins upon one party providing the other with written notice of the dispute. If the dispute remains unresolved after that period, it shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Pinellas County, Florida. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
YOU AND EVERYWAG AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND EVERYWAG EACH WAIVE ANY RIGHT TO A JURY TRIAL.
15. Electronic Communications
By using the App and providing your email address, you consent to receive electronic communications from Every Wag, including service-related notices, updates, and promotional messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You may opt out of promotional communications at any time through your App settings or by following the unsubscribe instructions in any email.
16. Force Majeure
Every Wag will not be liable for any delay or failure to provide the App to the extent caused by circumstances beyond our reasonable control, including natural disasters, pandemic, acts of government, internet or telecommunications outages, or failure of third-party infrastructure providers.
17. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email at least fourteen (14) days before the change takes effect. Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to a material change, you may delete your account before the change takes effect.
18. Copyright Infringement and DMCA
If you believe any content in the App infringes your copyright, you may notify our designated DMCA agent. Your notice must comply with the requirements of 17 U.S.C. § 512 and include: identification of the copyrighted work, identification of the allegedly infringing material and its location in the App, your contact information, a statement of good faith belief, and your signature.

We will respond to valid DMCA notices in accordance with applicable law. Repeat infringers may have their accounts terminated.
19. General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Every Wag with respect to the App and supersede all prior agreements or understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
You may not assign your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
The section headings in these Terms are for convenience only and have no legal effect.
