These Website Terms of Use (“Terms”) govern your access to and use of the Every Wag website located at everywag.com and its subdomains (the “Website”), owned and operated by Oh Rover, LLC d/b/a Every Wag (“Every Wag,” “Oh Rover,” “we,” “us,” or “our”), a Florida limited liability company.

By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Website.

These Terms apply to general visitors, prospective clinic customers, and pet owners visiting the Website for informational purposes. They do not govern use of the Every Wag mobile application or the Care Connect clinic platform, which are subject to their own separate terms available at everywag.com/legal.

The Every Wag Website is a marketing and informational website for Oh Rover, LLC, and its products, including the Every Wag pet care mobile application and the Care Connect veterinary clinic platform. The Website includes:

  • Product and feature information for veterinary clinics and pet owners
  • Pricing information for the Care Connect platform
  • A clinic-facing blog covering veterinary practice topics
  • A consumer-facing pet care blog covering pet health and wellness topics
  • Contact and demo request forms
  • Links to create an account or sign up for the Care Connect platform

Content on the Website is provided for informational purposes only. Nothing on the Website constitutes veterinary advice, a diagnosis, or a treatment recommendation. Always consult a licensed veterinarian for advice specific to your pet’s health.

2. Eligibility and Acceptable Use

The Website is intended for use by adults aged 18 and over. By using the Website, you represent that you are at least 18 years old. If you are accessing the Website on behalf of a veterinary clinic or other business, you represent that you have authority to act on that entity’s behalf.

The Every Wag clinic blog publishes articles, guides, and resources intended for veterinary professionals and practice managers. Blog content is provided for general informational and educational purposes only. It does not constitute legal, financial, regulatory, or veterinary medical advice. Clinic operators should consult qualified professionals before making practice management or clinical decisions based on blog content.

4.2 Pet Care Blog

The Every Wag pet care blog publishes articles and resources intended for pet owners. Content on the pet care blog is for general informational purposes only and is not a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the guidance of a licensed veterinarian with questions regarding your pet’s health.

4.3 Blog Accuracy and Currency

Every Wag makes reasonable efforts to ensure blog content is accurate at the time of publication. However, veterinary medicine, regulations, and best practices evolve over time. We do not warrant that any blog content remains current or accurate after its publication date. Every Wag reserves the right to update, modify, or remove blog content at any time without notice.

4.4 User Comments

If the Website enables comments or other user-generated contributions on blog posts, you are solely responsible for any content you submit. You agree not to post content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable. Every Wag reserves the right to remove any user-submitted content at its sole discretion and without notice. By submitting comments, you grant Every Wag a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, sublicense, and display such content in connection with the Website and Every Wag’s business.

Actual pricing is confirmed at the time of subscription purchase through the Care Connect platform. Descriptions of platform features on the Website are for informational purposes. The Care Connect Clinic Terms of Service govern the actual use of and access to the platform and take precedence over any Website descriptions in the event of a conflict.

9. Disclaimer of Warranties

THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERYWAG DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Every Wag does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content on the Website.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OH ROVER, LLC, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Every Wag’s total aggregate liability for any and all claims arising from or related to your use of the Website, including direct damages, shall not exceed one hundred dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Oh Rover, LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website in violation of these Terms; (b) any content you submit through the Website; (c) your violation of any applicable law or regulation; or (d) your violation of any third party’s rights.

Every Wag’s collection and use of personal information submitted through the Website is governed by our Privacy Policy, available at everywag.com/privacy-policy. By using the Website, you consent to the data practices described in the Privacy Policy.

13. Cookies and Analytics

The Website may use cookies, pixels, and similar tracking technologies to understand how visitors use the Website, improve user experience, and support marketing activities. By using the Website, you consent to the use of these technologies in accordance with our Privacy Policy. You may adjust your browser settings to refuse cookies, though doing so may affect certain Website functionality.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Website that cannot be resolved informally within thirty (30) days shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Pinellas County, Florida. Each party shall bear its own attorneys’ fees and costs in connection with any arbitration, except to the extent AAA rules require Every Wag to pay filing or administrative fees. The arbitrator’s decision shall be final and binding, and the parties expressly waive any right to appeal the arbitration award to the fullest extent permitted by applicable law.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

15. Changes to the Website and These Terms

Every Wag reserves the right to modify, suspend, or discontinue any part of the Website at any time without notice. We also reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Website after updated Terms are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
